• The actual scope of work differs from what was visible or described at the time of the estimate
• Hidden conditions are discovered during work (such as base failure beneath the surface)
• Material costs change between the time of estimate and the time of job completion
• The customer requests changes to the scope of work after the estimate is issued

We will communicate any material pricing changes to you before proceeding with affected work. A written change order or authorization will be required for any significant scope changes.

4. Scheduling and Cancellation

Scheduling is subject to crew availability and weather conditions. Asphalt work requires suitable temperature and dry conditions; we reserve the right to reschedule any job due to rain, extreme heat, or other weather conditions that would compromise the quality of the work.

If you need to cancel or reschedule, please contact us as soon as possible. Cancellations with less than 48 hours notice may be subject to a cancellation or restocking fee if materials have already been ordered or mobilization costs have been incurred.

We reserve the right to cancel or decline any job at our discretion. In such cases, any deposits paid for work not yet performed will be refunded.

5. Payment Terms

Payment terms will be specified in your written estimate or contract. Standard terms require payment in full upon completion of work unless otherwise agreed in writing. For larger projects, we may require a deposit before work begins, with the balance due upon completion.

Accepted payment methods will be communicated at the time of engagement. Unpaid invoices are subject to late fees as permitted by applicable California law. If collection action is required, you agree to pay reasonable collection costs and attorneys fees incurred.

6. Customer Responsibilities

You agree to:

• Provide accurate information about the property and the scope of work needed
• Ensure the work area is accessible and clear of vehicles, equipment, and obstructions prior to the scheduled start time
• Keep people and animals away from the work area during and immediately after the job
• Follow all post-service care instructions provided by our crew (including curing times for fresh asphalt or sealcoat)
• Obtain any necessary permits or HOA approvals before the scheduled start date, unless the scope of work includes permit procurement by our company

Damage resulting from your failure to follow post-service care instructions is not covered by any warranty.

7. Warranty Disclaimers

Where a written warranty is provided in your service contract, that warranty governs the Company's obligations. In the absence of a written warranty, all services are provided "as is" and without warranty of any kind, express or implied.

No warranty covers damage resulting from:

• Normal wear and weathering
• Ground movement, seismic activity, or expansive soil conditions
• Vehicle oil or fluid leaks on the surface
• Use of the surface by overweight or heavy equipment not disclosed at the time of job planning
• Failure to follow post-service care instructions

8. Limitation of Liability
